Terms of Service

1. Acceptance of Terms

1.1. By using the services provided by Medicanna Health (“we,” “our,” or “us”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you should not use our services.
1.2. Medicanna Health reserves the right to modify these Terms at any time. Any updates will take effect immediately upon notification via our website or email. Your continued use of our services constitutes acceptance of any revised Terms.

2. Services Provided

2.1. Medicanna Health provides access to consultations with registered healthcare practitioners (“Practitioners”).
2.2. Our services are delivered through telehealth consultations. We do not operate a physical clinic.
2.3. We do not guarantee that a prescription or treatment will be provided following a consultation. The decision to prescribe is at the sole discretion of the Practitioner.

3. Patient Responsibilities

3.1. You must be at least 18 years old to use our services. Patients under 18 must have a parent or legal guardian present during the consultation.
3.2. You agree to provide accurate and complete information about your medical history, current medications, and any other relevant health details.
3.3. You understand that the effectiveness of any treatment depends on following medical advice and properly using prescribed medications.
3.4. You must ensure that you are available and prepared for your scheduled consultation at the agreed time.
3.5. If you choose to use your own preferred pharmacy, a scripting fee may apply to cover additional processing steps required for medication dispensing.

4. Consultations and Medical Advice

4.1. Consultations are conducted remotely by Medicanna Health Practitioners.
4.2. All medical assessments, diagnoses, and treatment recommendations are made solely by the Practitioner during the consultation. Medicanna Health does not influence or interfere with medical decisions.
4.3. If a Practitioner determines that you do not qualify for treatment, no refund will be provided for the consultation.

5. Fees and Payments

5.1. Fees for consultations and related services are as outlined at the time of booking. Prices are subject to change.
5.2. Payment must be made at the time of booking.
5.3. We do not offer refunds for missed appointments. However, if you inform us at least one working day before your scheduled consultation, we can reschedule your appointment at no additional cost.

6. Privacy and Confidentiality

6.1. Your privacy is important to us. All personal and medical information is handled in accordance with our Privacy Policy and relevant legal requirements.
6.2. We do not share your personal information with third parties except where required by law or with your consent.

7. Limitation of Liability

7.1. Medicanna Health provides access to healthcare services but is not responsible for the outcomes of any medical treatment provided by Practitioners.
7.2. To the fullest extent permitted by law, Medicanna Health disclaims all liability for any direct, indirect, or consequential damages arising from the use of our services.
7.3. Our total liability to you for any claims arising from our services is limited to the amount paid for the consultation in question.

8. Indemnification

8.1. You agree to indemnify and hold harmless Medicanna Health, its affiliates, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services.

9. Termination of Services

9.1. We reserve the right to refuse or terminate service at our discretion, including but not limited to cases of inappropriate behavior, abuse of services, or failure to comply with these Terms.

10. Governing Law

10.1. These Terms are governed by and interpreted under the laws of Victoria, Australia.
